Welcome to HeadStrong. These Terms of Service ("Terms") form a legal agreement between you and HeadStrong ("HeadStrong", "we", "us", or "our") governing your access to and use of our website, mobile application, and related services (collectively, the "Service"). Please read them carefully — by using the Service you agree to these Terms.

Important: HeadStrong is a wellness and self-help tool, not a medical device, and is not a substitute for professional medical, psychiatric, or psychological care. If you are experiencing a mental health emergency, call or text 988 (US) or dial your local emergency number immediately.

1. Who Can Use HeadStrong

You must be at least 13 years old to use HeadStrong. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf. Certain features may have higher age requirements as noted in the app.

2. Your Account

To access most features of HeadStrong you'll need to create an account. When you do, you agree to:

Provide accurate, current, and complete information.
Keep your password secure and not share it with others.
Be responsible for all activity that occurs under your account.
Notify us immediately if you suspect unauthorized access.

3. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose or in violation of these Terms.
Harass, abuse, threaten, or harm other users (including in peer chat).
Attempt to bypass, disable, or otherwise interfere with security-related features of the Service.
Reverse engineer, decompile, or attempt to extract source code from the Service.
Use automated means (bots, scrapers) to access, collect data from, or interact with the Service.
Post or transmit any content that is illegal, infringing, defamatory, or contains malware.
Impersonate another person or misrepresent your affiliation with a person or entity.
Use the Service in a way that could damage, disable, overburden, or impair our servers.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Not Medical Advice

HeadStrong provides tools for self-reflection, wellness tracking, and emotional support — but it does not provide medical advice, diagnosis, or treatment. Content generated by our AI companions (Liam and Ariel), quiz results, and wellness insights are for informational and educational purposes only. You should always consult a qualified healthcare provider for questions about your physical or mental health, especially before making any decisions regarding medications, therapies, or treatment plans.

HeadStrong is not a crisis service. If you are in crisis, experiencing thoughts of self-harm, or need immediate help, please contact emergency services or a crisis hotline right away.

5. AI Companions

HeadStrong's AI companions (Liam and Ariel) use large language models to generate conversational responses. These responses are generated by software, not by licensed mental health professionals. They may occasionally be incorrect, incomplete, or inappropriate for your situation. You understand and accept that:

The AI is not a therapist and cannot replace one.
Responses are generated from patterns in training data and may reflect limitations or biases.
You should use your own judgment and consult professionals for anything serious.

6. Peer Support

HeadStrong may include features that let you connect with other users for anonymous peer support. When you use these features:

You agree to treat other users with kindness and respect.
You agree not to share personally identifying information about yourself or others.
You understand that other users are not licensed professionals and their input is not therapy.
We use automated crisis detection systems to help keep conversations safe, but no system is perfect.

7. Subscriptions and Payments

HeadStrong offers free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). You can cancel at any time — cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by law.

Prices, features, and billing terms may change from time to time. We will notify you of any material changes before they take effect.

8. Your Content

You retain ownership of any content you submit to the Service (check-ins, journal entries, messages, etc.) ("Your Content"). By submitting Your Content, you grant HeadStrong a limited, non-exclusive, royalty-free, worldwide license to use, store, display, and process Your Content solely for the purpose of providing and improving the Service to you. We do not claim ownership of Your Content, and we do not use it to train external AI models.

9. Our Content

The Service — including its design, text, graphics, code, logos, and trademarks — is owned by HeadStrong or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written permission.

10. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service you agree to our collection and use of information as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HEADSTRONG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

HEADSTRONG MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED BY THE SERVICE, INCLUDING AI-GENERATED RESPONSES, QUIZ RESULTS, OR WELLNESS INSIGHTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEADSTRONG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL HEADSTRONG'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HEADSTRONG IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless HeadStrong and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease, but sections that by their nature should survive termination will continue to apply.

15. Changes to the Service

We are constantly improving HeadStrong. We may add, remove, or change features at any time. We may also suspend or discontinue the Service (or any part of it) with or without notice. We will not be liable to you or any third party for any such modifications or discontinuation.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice within the Service. Your continued use of the Service after any changes indicates your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
